After the abrogation of Article 370, this is what has happened. So, I am talking about bringing in repeals, amendments and all these things. Anyway, you are doing it on your own, just because you have a brute majority. I request the Union Government to at least listen to the Opposition and have discussions and deliberations. Even now, you are bringing in some laws 16.12.2025 1080 whose names we cannot understand. Today, we are even changing the name of a Bill whose name I was not even able to pronounce. I am not even able to understand these words. So, I request the Government to ensure that when they are bringing in a Bill, they make it in English, so that the whole country can understand it, and that you do not try to push Hindi down our throats by saying that these are the names of Bills and we have to say those names. With these words, I oppose this Bill and hope that the Union Government will take cognisance of these words. Thank you. SHRI SRIBHARAT MATHUKUMILLI (VISAKHAPATNAM): Thank you, Sir. I rise to stand in support of the Repealing and Amending Bill, 2025, which addresses a subject that lies at the very heart of effective governance and is also very close to my heart. This is not optional; this is essential for a modern and dynamic democracy. Some of my colleagues in the Opposition who have spoken here have raised certain points, which I will address later in my speech. But one thing on which I believe we can all agree, is that change is the only constant. Our Constitution-makers recognised this timeless truth. They understood that governance must evolve with society and, therefore, built Article 368 as the constitutional engine for reform. They did not give us a static document; they gave us a living Constitution – a framework that entrusts future generations with the responsibility to amend, repeal, and refine laws as India progresses. Over the decades, however, our legislative system has developed serious 16.12.2025 1081 structural imbalances. I have personally experienced this in many aspects of my life, where governments are very good at adding laws, adding rules, and adding conditions, but are very poor at removing or updating outdated ones. This unnecessary burden is faced by everyone – from the common man to the poorest of the poor, and even by the highly wealthy. Every new policy brings with it fresh compliance requirements, new penalties, and additional layers of regulation. Rarely do we pause to ask whether old provisions have outlived their relevance or whether they now contradict newer laws. The result is regulatory congestion, which burdens citizens, businesses, and Government officers alike, creating confusion and discretionary enforcement. We have seen how some bad actors misuse this discretion to harm the interests of citizens and even the nation. I am happy to note that the current NDA Government has taken concrete steps over the last decade to relieve citizens and businesses of this burden. More than 40,000 unnecessary compliances have been abolished, easing procedural hurdles and reducing red tape. Over 1,500 outdated and redundant laws have been repealed, clearing the statute book of colonial-era provisions and laws that no longer serve India’s development. I would like to point out a few things here. Some Members of the Opposition have said that we are changing laws within three years or four years. We must recognise that we are living in the era of artificial intelligence and quantum computing, where the world is changing rapidly, and we have to keep adapting. 16.12.2025 1082 One must also reflect on the approach we adopt: whether we wait endlessly for perfection or ensure that we are good enough to move forward, while continuing to amend and improve as we go along. If I had to choose between perfection and being good enough to move forward, I would always choose being good enough because we should not be trapped in policy paralysis. This is important to highlight because during the UPA regime between 2004 and 2014, only a single repeal Bill was introduced, which repealed just two outdated laws. This starkly contrasts the approach of the current NDA Government with that of the earlier UPA regime, which largely neglected the task of revising and repealing obsolete laws. Sir, I am an active Member of the Select Committee on the Jan Vishwas (Amendment of Provisions) Bill,2025 and I have been participating actively in rationalising penal provisions and simplifying compliance, with the objective of improving ease of living and ease of doing business. I hope that the same principle keeps continuing. I am happy to hear that our hon. Minister Shri Piyush Goyal has mentioned that Jan Vishwas 3.0 is already under way. I think this is the sign of a healthy democracy where we keep evolving and keep looking at our past. While these reforms at the Centre have eased compliance and built trust, we need to do so at the State also where we have a lot of interaction with citizens. In our State, some regrettably damaging laws like the Land Titling Act or the Three Capitals Act that the earlier Government tried to push through, have 16.12.2025 1083 caused a lot of pain and confusion in citizens’ minds, damaging trust. As soon as the NDA Government came to power in Andhra Pradesh, we provided clarity and have repealed these laws which have gone against the interests of citizens. While these were in particular nefarious things, the overarching principle that repealing or revising the problematic laws that are creating conflict or laws that are outdated, is essential for bringing back transparency, trust, and predictability in governance. I look forward to aiding our State Government in continuing to do so. The Repealing and Amending Bill, 2025 is not merely an exercise in removing obsolete statutes; it reaffirms our fundamental principle of good governance that laws which have outlived their purpose must be repealed with the same resolve with which progressive laws are enacted. This House bears the responsibility not only to legislate for the present, but to free future generations from needless regulatory bodies. Hon. Chairperson, I thank you for giving me this opportunity to speak on this important Bill and I wish that the Government continues to do this to ensure that there is maximum governance, minimum government, empowering our citizens for a trust-based and efficient society. SHRI KALYAN BANERJEE (SREERAMPUR): Hon. Chairperson, Sir, this is the Repealing and Amending Bil, 2025. Every year, we bring these types of Bills. There is not much confusion about the Repealing and Amending Bill. There are some good parts which are corrected. One of them is regarding Speed Post. Instead of Registered with AD, it will now be Speed Post with AD. It is good. It 16.12.2025 1084 will be speedier. But I request one thing to hon. Law Minister. … (Interruptions) Hon. Law Minister, kindly see. So far as the caveat is concerned, the part which you have amended is that it has to be served upon the defendants or whatever the party. But a caveat is filed through the lawyer. Therefore, if you can put “the party and also the lawyer of the defendant”, that will help; otherwise, it will be useless. If you want speedy justice, then my suggestion is that you add ‘the lawyer of the defendant’ or whatever the party where it is made through the lawyer only. There is no problem on that. Sir, the problem is somewhere else. Now, we are amending the Act, we are bringing more and more Acts; but is speedy justice being delivered? Where are we stuck? I just give you one small example. When in the Supreme Court, filing of new cases was 40,000, the strength of the Supreme Court judges was increased to 34. In 2024, filing was more than 60,000. In 2025, till two days ago, filing was 70,000, but the strength of judges has not been increased. Computers and all that will not decide the fate of a case. A real judicial reform by increasing the strength of the judges is required. Unless it is done, nothing will be done in this country. So far as justice part is concerned, I am saying about it. We need more judges. If you go to the Registry of the Supreme Court, you will see that after registration of a case, it takes at least eight to ten days to remove the defects, etc. People are also not there. A similar situation is in the High Courts and district courts also. These computers etc. are all additional. We need original men to decide and they are the judges. The strength of the judges needs to be increased. Virtual courts etc. means we are just side-tracking the problem itself. 16.12.2025 1085 Unless the judges are there, who will decide? Although it may not relieve much, I now understand, but as the hon. Law Minister is here, to whom can I make a request. He can reject my request also. There is no problem. He is smiling and he will reject my request. But this is not the request from myself. I am almost at the end of my life. Please do it for the future of this country. People are having last faith in the Judiciary. People get the justice. We are talking about the women empowerment; we are talking about women torture; and we are talking about POCSO. Where are the judges? It is not my State; it is not your State; it is not your State, Rajasthan. It is the whole of India. Kindly think over it. आप हर बार आते ह§ और कुछ न कुछ बोलते ह§ । आप अपने िवषय को ठीक कर लीिजए । म§ अपनी बात कह रहा हóं । यह आपको अ¸छा नहé लगेगा । हम जो कुछ भी बोल रहे ह§, वह ठीक है । हम आपको कभी भी ईल एडवाइज नहé द¤गे । थ§क यू सर । ®ी कौशलेÆþ कुमार (नालंदा) : सभापित महोदय, आपने मुझे िनरसन और संशोधन िवधेयक 2025 पर हो रही चचाª म¤ भाग लेने कì अनुमित दी, इसके िलए आपका बहòत-बहòत धÆयवाद । सभापित महोदय, माननीय मंýी जी Ĭारा 120 पुराने और अÿसांिगक कानूनŌ को समाĮ कर कानूनी ढांचे को साफ और ÿभावी बनाने के िलए यह ÿÖताव लाया गया है । म§ इसका Öवागत करता हóँ और समथªन भी करता हóँ । 16.12.2025 1086 सभापित महोदय, यह िनरंतर चलने वाली ÿिøया है । आज समय के अनुसार कानूनŌ म¤ बदलाव और संशोधन हो रहा है । इसी ÿावधान के तहत माननीय मंýी जी पुराने और अÿचिलत हो चुके कानूनŌ को खÂम करने और उनम¤ वे संशोधन करने कì बात कह रहे ह§ । इससे कानूनŌ को सरल, ÖपĶ, पारदशê, सुÓयविÖथत और आधुिनक बनाया जा सकेगा । ÿशासन को बेहतर बनाया जाएगा उसम¤ पारदिशªता होगी । इससे कानूनŌ के ÿावधानŌ कì Óया´या ÖपĶ एवं सरल होगा । इससे आम जनता को भी लाभ िमलेगा । पुराने कानूनŌ से जो Ăम पैदा होता है, उसे भी दूर िकया जा सकेगा । सभापित महोदय, सरकार पुरानी कानूनी ÓयवÖथा को दुŁÖत करने का काम कर रही है । उÆह¤ आधुिनक बनाने और ÿशासन को कुशल एवं गितशील बनाने का काम सरकार कर रही है । इसके साथ ही संवैधािनक पदŌ पर नैितकता बनाए रखने के िलए भी आवÔयक कदम उठाने म¤ सरकार को मदद िमलेगी । यह कदम Öवागत योμय है । सभापित महोदय, पहले शेड्यूल म¤ 71 कानूनŌ को िनरÖत करना है, िजसकì अब जłरत ही नहé है । िफर दूसरे शेड्यूल म¤ पोÖटल सिवªसेस म¤ सुधार करने कì बात हो रही है । आपदा कानून म¤ हो रही परेशािनयŌ को दूर करने कì भी बात है । सभापित महोदय, कानूनŌ म¤ ये सब सुधार आवÔयक ह§ और यह आम नागåरकŌ के िहत म¤ है । देश का संिवधान आम नागåरकŌ के अिधकारŌ कì र±ा करता है । सरकार ने आम नागåरकŌ के िहतŌ कì र±ा के िलए साथªक कदम उठाया है । सभापित महोदय, म§ पुनः इस िबल का समथªन करता हóँ । धÆयवाद । ®ी उÌमेदा राम बेनीवाल (बाड़मेर) : माननीय सभापित महोदय, म§ आज इस सदन म¤ िनरसन और संशोधन िवधेयक, 2025 पर अपनी बात रखने के िलए खड़ा हòआ हóँ । िसĦांततः कोई भी सËय लोकतंý अपने कानूनŌ को समय-समय पर पåरÕकृत करता है, अÿासंिगक कानूनŌ को हटाता है और िविधक अÖपĶताओं को दूर करता है । कांúेस पाटê इस ÿिøया का िवरोध नहé करती, बिÐक ऐितहािसक łप से हमने ही भारत के िवधायी सुधारŌ कì नéव रखी है । िकंतु माननीय महोदय, मेरा 16.12.2025 1087 ÿij इस िबल कì मंशा नहé, बिÐक उसकì सीमा, ÿाथिमकता और ईमानदारी को लेकर है । ³या यह िबल वाÖतव म¤ कानूनी सुधार कì िदशा म¤ एक गंभीर ÿयास है या िफर यह सरकार Ĭारा अपनी िवधायी िनिÕøयता को छुपाने का एक औपचाåरक अËयास माý है? आज देश महँगाई, बेरोजगारी, िकसान संकट, संघीय ढाँचे के ±रण और संवैधािनक संÖथाओं कì Öवाय°ता जैसे गंभीर मुĥŌ से जूझ रहा है और सरकार ऐसे समय म¤ केवल तकनीकì सुधारŌ का ढोल पीट रही है । कानूनŌ को िनरÖत करना तब साथªक होता है, जब साथ ही नागåरकŌ के अिधकारŌ को मजबूत करने वाले नए कानून भी लाए जाएँ । दुभाªμयवश, िपछले कुछ वषŎ म¤ हमने देखा है िक सरकार सुधार के नाम पर ऐसे कानून लाई, िजनसे असहमित को दबाया गया और राºयŌ के अिधकारŌ पर अितøमण िकया गया । इसिलए, इस िबल पर चचाª करते समय हम¤ यह नहé देखना चािहए िक कौन-सा कानून हटाया जा रहा है, बिÐक यह देखना चािहए िक कौन-से अÆयायपूणª कानून आज भी जीिवत ह§, िजÆह¤ हटाने का साहस सरकार नहé िदखा रही है । माननीय सभापित महोदय, यह सदन जानना चाहता है िक िनरसन और संशोधन िवधेयक, 2025 कì परंपरा नई नहé है । पूवªवतê कांúेस सरकार के कायªकाल म¤ भी ऐसे अनेक िवधेयक लाए गए, िजनका उĥेÔय कानूनŌ कì Öव¸छता और ÿशासिनक ÖपĶता था, िकंतु उस समय यह ÿिøया एक Óयापक िवधायी सुधार एज¤डे का िहÖसा हòआ करती थी । आज िÖथित यह है िक सरकार केवल उन कानूनŌ को हटाने म¤ Łिच िदखा रही है, जो पहले ही िनÕÿभावी हो चुके ह§, जबिक वे कानून जो नागåरक Öवतंýताओं पर ÿÂय± या अÿÂय± łप से ÿहार करते ह§, उÆह¤ बनाए रखा गया है । उदाहरण के तौर पर, देश म¤ औपिनवेिशक मानिसकता से ÿेåरत कई दमनकारी ÿावधान आज भी लागू ह§, िजनका उपयोग पýकारŌ, छाýŌ और सामािजक कायªकताªओं के िखलाफ िकया जाता है । जैसे राजÖथान राºय, जहाँ लोकतांिýक चेतना और सामािजक Æयाय कì लंबी परंपरा रही है, वहाँ के लोग यह पूछ रहे ह§ िक ³या कानून केवल शासन कì सुिवधा के िलए ह§ या जनता के संर±ण के िलए भी है? इस िबल म¤ िजन कानूनŌ को िनरÖत िकया जा रहा है, उनम¤ से अिधकांश पहले ही अÿासंिगक हो चुके ह§ । ऐसे म¤ सरकार को यह बताना चािहए िक उसने अब तक िकतने ऐसे कानूनŌ कì समी±ा 16.12.2025 1088 कì है, जो आज कì संवैधािनक आÂमा के अनुłप नहé ह§ । ³या सरकार संघवाद को मजबूत करने वाले कानून लाएगी? ³या वह राºयŌ को उनके अिधकार लौटाने के िलए तैयार है? इन ÿijŌ के उ°र इस िबल के साथ जुड़े हòए ह§ और जब तक इन पर ÖपĶता नहé आती है, तब तक इस िवधेयक को केवल एक औपचाåरक अËयास माना जाएगा । माननीय सभापित महोदय, राजÖथान कì धरती से आने वाले जनÿितिनिध के łप म¤ म§ यह िवशेष łप से कहना चाहóँगा िक कानून का ÿभाव केवल िदÐली के दÉतरŌ तक सीिमत नहé रहना चािहए, बिÐक यह गाँव, ढाणी और गरीब कÖबŌ तक जाना चािहए । जब कोई कानून अÖपĶ होता है, तो उसका सबसे अिधक दुÕÿभाव úामीण गरीब, मजदूर और आिदवासी समुदायŌ पर पड़ता है । 15.00 hrs सरकार यह दावा करती है िक यह िबल ‘ईज ऑफ गवन¦स’ को बढ़ावा देगा, िकÆतु हम¤ पूछना चािहए िक ³या इससे ‘ईज ऑफ िलिवंग’ भी बढ़ेगी? ³या ऐसे म¤ िकसानŌ को समय पर Æयाय िमलेगा? ³या इससे युवाओं को रोजगार िमलेगा? राजÖथान के सीमावतê इलाकŌ म¤ रहने वाले लोग आज भी भूिम, पानी और आजीिवका से जुड़े कानूनी िववादŌ म¤ वषŎ तक अदालतŌ के च³कर लगाते रहते ह§, लेिकन उनको तारीख पर तारीख, तारीख पर तारीख िमलती रहती है और Æयाय का इंतजार करते- करते उनकì िजंदगी िनकल जाती है । ऐसे म¤ सरकार को नए और सरल कानून बनाने चािहए, तािक लोगŌ को समय पर Æयाय िमले और अदालतŌ म¤ लंिबत मुकदमŌ का िनÖतारण सही समय पर हो । उनको समय रहते Æयाय िमलना चािहए । नए जजŌ कì भी भतê कì जानी चािहए और ÿÂयेक Æयायाधीश के ऊपर मुकदमŌ कì सं´या तय होनी चािहए । ऐसे कानून लाए जाएं, िजनसे Æयाय िमलने कì समय सीमा तय हो िक िजला Æयायालय म¤ इतने समय म¤ Æयाय िमल जाएगा, उ¸च Æयायालय म¤ इतने समय म¤ और सवō¸च Æयायालय म¤ इतने समय म¤ Æयाय िमल जाएगा । अगर ऐसे कानून इस सदन से पास होते ह§ तो वाÖतव म¤ गांव के गरीब लोगŌ को Æयाय िमलेगा । सभापित महोदय, म§ आशा करता हóँ िक सरकार इसके बारे म¤ जłर सोचेगी । म§ इस सदन 16.12.2025 1089 का Åयान एक तÃय कì तरफ आकिषªत करना चाहता हóँ । िपछले कुछ वषŎ म¤ कानून बनाने कì ÿिøया म¤ संसदीय सिमितयŌ कì भूिमका को लगातार कमजोर िकया गया है । कई महÂवपूणª िवधेयकŌ को िबना पयाªĮ चचाª के सीिमत समी±ा से पाåरत िकया गया है ।
